Count 73 and 74 September 17 2009, sexual assault on Jane Doe forcible confinement of Jane Doe background 125 as of September 17 2009, Miss Jane Doe was 20 years old and lived at x x x x x road tweet with her boyfriend, Mr. X, X, X X and her then eight week old daughter. Her boyfriend worked out of town during the week, and she was there for usually alone with her baby during the week. They have only lived at this residence for a short time 126 prior to September 17 2009, Miss Jane Doe had never met Russell Williams. Evidence of Jane Doe on September 16 2009, Miss Jane Doe returned home from her mother's house between 930 and 10 o'clock p.m., Mr. X X X X was working out of town. She locked her front door but did not check the back patio door, believing it to be locked after having checked it the previous night at 11 o'clock p.m. with her daughter asleep. Miss Jane Doe then went to sleep in her own bedroom wearing a tank top and pajama pants. Miss Jane Doe was awakened by someone holding down her head. She thought she was dreaming. The person unknown to Miss Jane Doe at the time was Russell Williams. He remained holding her head down for some time, causing Miss Jane Doe to ask if she was going to be killed. Mr. Williams told her No, but would not disclose his intentions. She could not say how long he stayed like this, but she estimates it was approximately 30 minutes. Although she said it seemed like forever. Miss Jane Doe advised he was very strong. Mr. Williams told her it was 1 a.m. he asked her how long she had lived at that address, and where the father of her child was. Miss Jane Doe responded that she had lived there for a month but refused to answer the second question. Mr. Williams then manipulated her to the side of the bed, sat on her buttocks and put his hands on her back. Then he struck her very hard three times on the head and told her to be quiet. Mr. Williams was also adamant they Miss Jane Doe not see his face. At one point. Miss Jane Doe told him that he did not seem like the type of person that would do something like this. After this, Mr. Williams seemed to get, quote, nicer, quote. Mr. Williams then tried to tie up her hands but had little success. He tried using a baby blanket a receiving blanket and a pillowcase, but it was initially unsuccessful. Ultimately, he tied her hands with a pillowcase shaped into ties and led her to the living room. He repeatedly uttered that he needed control over her to allow him to walk her to another room. Miss Jane Doe heard him take something from her bag and then return to her bedroom. She asked what was happening to which Mr. Williams responded that quote, you'll see and quote, he told her he was not going to hurt her. At one point Miss Jane Doe told Mr. Williams that she was fat, having just had a baby. Her belief was that hopefully Mr. Williams would find her unattractive and therefore leave. Mr. Williams, however, told her she was perfect and sweet. Upon their return to her bedroom, Mr. Williams put a pillowcase over her head. This ultimately made her claustrophobic so Mr. Williams use it as a blindfold. He then slid down the right side of her tank top, revealing her right breast. He took a photograph of her. He then slid down the whole tank top and took another photograph of her breast. He also repeatedly touched her breasts. Then next he had her take her pants off and took more photographs of her. He had her spread her legs and he took a photograph of her vaginal area. This made Miss Jane Doe very upset. But Mr. Williams said he was not going to do anything further and that he was going to leave after that. Mr. Williams then left the room, leaving Miss Jane Doe alone in her bedroom. She thought he was in her daughter's room, but she was not sure she did not know what he was doing. Then. She then heard Mr. Williams return and seemingly open her drawers. She could not be sure, but she thought he was looking for her underwear. He also took all the sheets off her bed. She later noted that she was missing bras and underwear. Mr. Williams had Miss Jane Doe stand up. He touched her breasts again and put his face up against hers. He had asked her her daughter's age. Finally he told to count to 300 she got to 70 and stopped upon which Mr. Williams told her to keep going. She got to 200 and yelled out, but did not hear anything in return. She undid her blindfold and called various people, ultimately speaking to Mr. X X X X X's his mother. She then called 911. 142 Miss Jane Doe did not hear any cars or boats leave her area. 143 Miss Jane Doe believe that Mr. Williams was there for approximately two hours in total, because he told her it was 1 a.m. at the beginning and she called the police at approximately 3 a.m. 144. She did not suffer any physical injuries and did not request medical attention. 145 Despite not having seen the face of her attacker, Miss Jane Doe offered the following description. A perhaps between 30 and 50 years of age to her he seemed like a dad. B not that tall. Perhaps a head taller than she was five two C. average belt. D she did not feel any facial hair. He He did not have glasses. F. he did not have anything covering his face. G, she thought he was wearing all black but could not be sure. H., His sweater was tight. And she ripped it at one point by grabbing at it. I. he was wearing hiking boots. J. He tried to make his voice sound deep and breathe loud. K., he had a ring on his finger, but she was not sure which hand and L he smelled dirty. 146 She described the camera as being a fancy one, not a regular digital one. It had a strap which she found unusual and its flash was brighter than normal. She believes he took about seven photographs in total Miss y y y y y Mr x y x y x y x y and Mr Z ZZ Z Z Z147. As noted above, Miss Jane Doe first spoke to miss x x x x Mr x x x x x x's mother Miss x x x x x told police that she received a call around 3 a.m. from Miss Jane Doe, who repeatedly told her that someone had been in her house. Miss x x x x x told her that they would be right over then she yelled downstairs to Mr x y x y x y x y Mr x x x x x his brother and his friend Mr. Z, Z Z, Z, Z Z, who was sleeping over and told them to get dressed and that they were going to Miss Jane Hoe's house. 148 all three arrived at x x x x x road in about 10 minutes and knocked on the window to get Miss Jane Doe's attention. She was on the phone, but ultimately came to the front door and unlocked it. Mr x x x x x and Mr. X X X X. checked the back patio and the area between Miss Jane Doe's house and those next to her but saw nothing. Mr. X X X X X believed to the back patio was unlocked. The police arrived between 10 to 15 minutes after the x x x x is initial police investigation 150 police dispatch received Miss Jane Doe's 911 call at approximately 3:15 a.m. officers Young and Sharp from the central Hastings department of the OPP arrived on scene shortly thereafter, and found Miss Jane Doe along with Miss at y y y y y Mr x y x y x y x y and Mr. Z ZZZZ. They quickly check the area including the lake for boats but found nothing. Over the course of the morning they had also stopped and spoke to the occupants of vehicles traveling on Charles road, and then other witnesses they spoke to saw or heard anything 151 by 7:35 a.m. identification Constable Jane Pelerin identification Constable Nicole Burley of the OPPforensic investigation Services Unit arrived on scene an examined Miss Jane Doe's home for evidence. Their search revealed among other things the following A. a screen had been cut on one of the side windows to the home B. Miss Jane Coe's bed was bare of sheets and blankets. C. a debate on the floor had been stripped of its cover and D the two pillowcases Mr. Williams used to tie her hands and blindfold her we're located in her daughter's bedroom. 152 Officers Pelerin and Burley also swabbed various parts of both Miss Jane Doe and her bedroom in an effort to find DNA samples suitable for comparison analysis. They obtained amongst others a sample from the back of her neck, later determined to be suitable for DNA analysis. 153 Following Miss Jane doe's attack, a police canine unit also searched the area, but was unable to come up with any significant leads 154. Despite a thorough investigation over the next weeks and months, they included that included the identification and elimination of possible suspects. The police were unable to identify Miss Jane Doe's attacker until Russell Williams was interviewed by the police on February 7 2010. Interviewed Russell Williams, as has been noted, Russell Williams was asked by police to attend the Ottawa police station for an interview. In the course of a very detailed interview, Mr. Williams acknowledged being the perpetrator of the crimes against Jane Doe. 156 Mr. Williams told Detective Sergeant Smith that he did not know Miss Jane Doe. He saw her at one point from his boat on Stocco Lake and thought she was cute. In the early morning of September 17 2009, he broke into her house through a side window by cutting the screen. He is wearing a sweatshirt and dark pants and had his face covered with the same cap he wore during his later attack on Miss Massicotte. Miss Jane Doe was in her bed sleeping, he stood over her for a while and then hit her on the left side of her head with his hand, causing her to wake up. They struggled and he subdued her by lying on top of her. 157 he pulled her top down, took her pants off and took some photographs and according to him left, before doing so he took one of her shirts, a sheet and a baby blanket because he had touched them and did not want to leave his leave evidence of his involvement behind. He also took five pieces of herr underwear. He put these in his Tweed home and ultimately disposed of the shirt she MBB blanket at the Tweed dump 158. During the attack, Miss Jane Doe told Mr. Williams that she had a young child, but he assured her that he was not going to hurt either her or the baby. 159 He downloaded the photographs he took a miss Jane Doe on his computer, forensic evidence and evidence seized from from Russell Williams residences. 160 Male specific DNA testing of the swab from the back of Miss Jane doe's neck was analyzed by the Center for forensic sciences and produced a partial DNA male DNA profile suitable for comparison analysis. The CFS then compared this profile to that obtained from Mr. Williams following his arrest. Qualified forensic biology experts concluded that Mr. Williams could not be excluded as the source of the partial male DNA profile, and the probability that a randomly selected and unrelated male would share the same DNA profile was found to be one in 1845 Caucasians one in 105 1511 Blacks, one in 318 Asians. 161. As noted above, Russell Williams admitted to Detective Sergeant Smith that his crimes against all four victims, including Miss Jane Doe, were recorded on two hard drives that were in his Ottawa residence. He told Detective Sergeant Smith that he kept everything hidden in file folders so that his wife would never discover the evidence of his criminal activities. As noted above the police's examination of these hard drives confirm that Mr. Williams help log this evidence in a deeply nested and complex series of sub folders. Specifically, Detective Sergeant Jim Falconer found Russell Williams kept evidence of his crime against Jane Doe in folders on his computer. The various folders contained A. a folder containing two documents one is labeled, quote, Jane Doe dot d. o. c. and quote in this document, Russell Williams had has written a great deal in great detail his attack on Miss Jane Doe. It is a two page document dated September 20, 2009. B. The second document is labeled, quote the Jane Doe series dot png and quote, and it is a one page document that contains all nine of the photographs Mr. Williams took a Miss Jane Doe during his attack on her on September 17, 2009. These are also saved individually in another folder. The first photograph at 2:47 a.m, displays Miss Jane Doe with the pillowcase blindfolding her eyes, she's sitting at an awkward angle on the side of the bed. Her arms are behind her back, presumably tied, and her camisole top is either drooping or pulled down somewhat partially revealing her right breast. The second photograph is at 2:48 a.m is a photograph taken from Miss Jane Doe's right side, showing her head and chest area. The bed is in the background. She's blindfolded. Her arms appear to be tied behind her back and her top is now pulled down revealing her right breast. The third photograph is also taken at 2:48 a.m. and displays Miss Jane Doe in the same position as the second photograph. It is a closer shot photo, and the photo only reveals the top of her breasts but it is clear from the photo that both her breasts are now exposed. The fourth photograph is similar is a similar photograph, taken at 2:49 a.m. and shows Miss Jane Doe. The photograph is taken with a wider angle and her breasts are now both exposed. Her camisole top is rolled down to her waist area. The fifth photograph is taken from a wider angle at 2:49am. It shows Miss Jane Doe from her nose down to her upper mid thigh area. The camisole top is around her mid waist and both her breasts and pubic area are exposed. The sixth photograph at 2:51 a.m. shows Miss Jane Doe sitting on the bed at a different angle. As in the other photos she remained blindfolded and the only clothing is her camisole rolled around her mid waist. She's visible from the blindfold area down to her knee with both breasts and her pubic area exposed. She appears very distraught in the photograph. The seventh photograph is at 2:51 a.m. and she is sitting on the bed turned toward the end of the bed similarly exposed her legs are spread. She and she appears distraught. Mr. Williams has taken this photograph from a different angle to be able to focus on her. The eighth photograph is taken at 2:55 a.m. Miss Jane Doe is now fully sitting on the bed with her knees apart. She's similarly clothed and remains distraught. The photograph clearly displays her breast and pubic area including her vagina, and the ninth photograph is taken at 2:55 a.m. and shows Miss Jane Doe sitting on the floor against the wall. Her camisole is now covering her bras and she is now wearing pajama pants. She remains blindfolded and still appears to have her hands bound behind her back. See a folder containing six photographs. Mr. Williams has laid out the shirt, the sheet, the receiving blankets and the baby blanket he took from Miss Jane doe's house on a flat surface and photographed them individually.
